Legal Information Line

The Oklahoma Association of REALTORS® is pleased to offer one of the most beneficial member services provided by the association. The OAR Legal Information Line is designed to answer your day-to-day questions on legal aspects of today’s real estate industry. It’s a benefit of your membership in OAR.

If you're not currently a subscriber, click here to download a user agreement. Simply fill it out and fax it to the OAR offices. You'll be contacted by a staff member with a Personal ID number - in most cases within one business day. The toll-free number is then open to you and your assigned caller, if applicable. Calls to the Legal Information Line must be made by the broker/owner or assigned caller. Other callers will be referred back to the broker.

The OAR Legal Information Line is staffed by attorneys from the law firm of Riggs, Abney, Neal, Turpen, Orbison & Lewis, a Professional Corporation. It’s not intended to be your lawyer or replace your own legal counsel. The OAR Legal Information Line has one purpose: to provide direct toll-free access for our members to a qualified attorney who can provide general information on real estate law and related matters. The goal is to increase professional knowledge and decrease your professional liability. The Designated REALTOR® (principal broker or branch office manager) and one Assigned Caller are authorized to use the service.

When you use the Legal Information Line, you should bear in mind the following things:

  • The Legal Information Line cannot substitute for your own legal counsel; it will only provide general legal information. Using the Legal Information Line forms no attorney-client relationship. Accordingly, communications through the Legal Information Line are not privileged.
  • The names of other parties or REALTORS® who may be involved in a particular transaction must not be mentioned.
  • Make sure your understand the information given to you. If you do not understand, please ask for a further explanation.
  • The information you receive from the Legal Information Line is based only on the facts you provide. If those facts are disputed, or if there are facts not mentioned, the information provided could be quite different.
  • The Legal Information Line cannot provide information for your clients or customers. The information obtained through the Legal Information Line is intended to be used solely by the authorized users. If there is a legal dispute, you should suggest that the parties retain their own legal counsel or seek resolution through arbitration.

What To Expect When You Call
When your call is answered, the Legal Information Line Attorney will verify your access to the service. There will be times when the attorney is not immediately available, and your call will be returned as soon as possible. To avoid "phone tag," we recommend you provide a number where you may be reached directly. If there are certain times when a return phone call is not convenient, please state that in your message.

GUIDELINES

The Legal Information Line will answer calls from 8:30 a.m. to 5:00 p.m., Monday through Friday, excluding holidays. The Legal Information Line number is 800-414-3161. Each caller is limited to one subject per call.

There is a maximum of two authorized callers from each member office: the Designated REALTOR® and one other Member registered by the Broker. Member Associations (Local Boards) will also have access to the Legal Information Line through the Association Executive. Other REALTORS® in the firm may obtain Legal Information Line information via their authorized callers. All callers will be required to give an access number with each call and therefore must be registered with OAR.

Each registered caller will use his or her Member I.D. number (which will be assigned by OAR) for access and should be prepared to give that number to the attorney answering the call. The list of callers and access codes will be maintained through OAR.

The lawyer who takes your call will be prepared to answer questions pertinent to real estate brokerage.

The intent of the OAR Legal Information Line is to provide an immediate verbal response to a legal question. No question will be answered on matters that are unrelated to real estate, currently in legal proceedings or that concern disputes or potential disputes between REALTORS®. When you call the Legal Information Line, you will be speaking directly to an attorney whose sole purpose is to give you general legal information in response to your inquiries.

Do not expect the Legal Information Line to replace your own legal counsel. Legal Information Line attorneys can answer questions only on the general facts provided, and should not be asked to second-guess your own attorney who might have access to other significant details. There may be times when the only information the Legal Information Line will give you is to consult your own legal counsel.

The first step you must take is to complete the Legal Information Line User Agreement to gain caller access. Click here to request a form. Fill in the requested information and return it to OAR either by mail or FAX. You will receive confirmation of your authorized participation in the OAR Legal Information Line within 24 to 48 hours.

Each Designated REALTOR® (principal broker or branch office manager) should list himself or herself as the primary caller. Please note that either caller may use the Legal Information Line at any time during established Legal Information Line hours.
